AMH 3552: Constitutional History of the United States from 1877
This course is
the companion course to AMH 3551, Constitutional History of the United States
to 1877. Both courses focus on constitutional issues in United States history.
AMH 3552 considers the rise of individual rights (or "rights talk")
in United States history in the period after Reconstruction. In Spring 2001, we
will focus particularly on the evolution of the idea that rights against the
state governments were incorporated into the 14th Amendment. We will
consider arguments for and against incorporation of the Bill of Rights into the
14th Amendment, and examine theories substantive due process.
